Privacy Policy

Introduction

Surfari Campers (“the Company”) is committed to protecting the privacy of its Customers. A person’s privacy in Australia is regulated by the Commissioner of Australian Office of Information Commission (the AOIC), a government agency responsible for the Privacy Act 1988 (Cth) (‘the Act’).  

This company adheres to the Act, in its application of this privacy policy. If legislative amendments to the Act take place after the effective date of this policy, the Act supersedes this policy.

The purpose of this policy is to explain how we, the Company, collect, use, store, share and dispose of personal Information. 

Scope

This policy applies to all Customers, and prospective Customers, their agents and anyone acting on or behalf of or for Customers. Collectively we use the term ‘Customer’ to cover all persons listed here, for the purpose of this policy. 

Personal Information

Personal Information is Information relating to an individual which personally identifies an individual or makes the person's identity reasonably apparent. This is typically, name, address, contact details, such as email address and phone number, and date of birth.  

Sensitive Information

Sensitive Information is personal Information or an opinion that is typically about an individual's racial or ethnic origin, political opinions, membership of a political association, religious beliefs, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences, criminal record, banking and credit card details, Tax File Number, health and biometric Information or similar such Information. 

Collection of your information

The Company will only collect personal and sensitive Information from Customers if it is reasonably necessary for the Company’s functions or activities. We may collect this Information from you, or from another organisation. 

Information collected prior to the Transaction with The Company

It is the Company’s usual practice to collect personal Information from the Customer to enable a purchase of goods or services (the Product) that the Company sells (the Transaction). 

Prior to the Transaction, the Company may obtain Information through the mechanism of the Customer making an enquiry, via phone call, website enquiry, or other enquiry, made prior to a Transaction. 

Further personal or sensitive Information may be obtained during or after the Transaction, to effect a legally binding Transaction. 

The types of Information we may collect are:

Personal Information:

  • Your full legal name,

  • Your physical address,

  • Your contact details, such as email address and phone number, 

  • A record of your communication to us,

  • Your web browser details that you used to access our website.

Sensitive Information:

  • Your payment Information, such as credit or debit card details, 

  • Identification documents including passport and driver’s licence.

The Company may also collect other personal Information if required or authorised to do so by law. 

Use of your information

The purposes for which the Company may collect, use, and disclose personal Information include (but are not limited to):

  • Processing Transactions: To complete the purchase and delivery of prefabricated campervan fit-outs (the Product), including payment processing and invoicing.

  • Customer Service: To respond to inquiries, provide support, and manage customer relationships.

  • Marketing: To send promotional communications and Information about new products, services, or special offers. You can opt-out of receiving these communications at any time.

  • Improving Services: To analyse customer feedback, preferences, and usage patterns to enhance our products, services, and website.

  • Legal and Regulatory Compliance: To comply with applicable laws, regulations, and industry standards, including for record-keeping, reporting, and responding to legal requests.

  • Fraud Prevention and Security: To detect, prevent, and address security breaches, fraud, and other prohibited or illegal activities.

  • Business Operations: For internal purposes such as data analysis, audits, and improving operational efficiency.

  • Insurance: To liaise with insurers in respect of any insurance policies that relate to you.

  • Litigation and Investigations: To defend the Company in any investigation or litigation and comply with court or tribunal orders for disclosure.

By providing your personal and/or sensitive Information, you consent to the Company using it for the purposes outlined above. We will ensure that your Information is handled securely and only used for the purposes for which it was collected.

Secondary use of your personal Information for company marketing purposes

The Company may request to use your personal Information on its website, social media or in other publicly available resources. We will not use your personal Information for this purpose without your consent. Should you consent, the types of personal Information we may use includes your name, your image, details of the product you purchased, which may also inadvertently disclose the make and model Information of your vehicle.

You may withdraw consent for marketing communications or secondary use for marketing purposes, at any time by following the opt-out process provided in each communication or contacting us directly.

Disclosure of your information

The Company may disclose personal Information, and where strictly necessary, Sensitive Information, to third parties including:

  • Transport or freight handlers and their staff and agents, engaged to deliver your purchase;

  • other companies within the Company’s group;

  • employees and contractors working for the Company, to the extent this is necessary for the operation of the Company’s business;

  • Service providers, including, internet service providers, cloud storage service providers, software suppliers, maintenance and support service providers, bookkeeping software services, and security services on a confidential basis so that they can provide services to the Company;

  • Finance or credit providers, payment processing services such as PayPal, or buy now pay later credit providers, to complete the Transaction; 

  • Law enforcement agencies such as State or Federal Police, Immigration and Border Control, or

  • Any other occasion where we are legally obligated to disclose. 

The Company ensures that third parties receiving your personal Information are required to handle it in compliance with the Act.

Storage of your information

The Company will always endeavour to maintain an accurate record of all personal and sensitive Information it holds. Customers should ensure that all personal Information provided to the Company is accurate and up to date and notify the Company of any changes where required.

The Company will store all Personal and Sensitive Information, on a strictly confidential basis, in compliance with the requirements of the Act. The storage of such Information may be on physical servers, cloud servers or Company computers, where the use of such, is controlled by internal policies controlling the use of.

In addition, The Company complies with Section 262A of the Tax Administration Act 1953 (Cth) and retains records that might contain customer Information, for at least five years after the completion of the Transaction.

Access to information

Personal and Sensitive Information held by the Company in respect of Customers is subject to the Act and does not have to be disclosed on request, unless required to be disclosed by law. 

Disposal of information

The company will store Customer personal and sensitive Information, for as long as it is lawfully entitled under the Act, and other relevant legislation, such as the Tax Administration Act 1953 (Cth)

Where the company is no longer bound by legislative compliance to retain Customer records, it may elect to destroy personal and sensitive Information without further notification to the Customer. Disposal methods will be via secure shredding conducted internally on premises or via the services of a Document Destruction service provider, and where the Information is digital, the permanent deletion of electronic data will occur. 

The disposal of records will be documented and signed off by senior management for authorisation and approval. A Document Destruction Record will be retained permanently, as part of the Document Control System.

Raising a concern or a complaint

If you have any concerns about the use of your personal or sensitive Information you are encouraged to contact the Privacy Officer of the Company.

The Company will generally ask for your concern or complaint to be submitted in writing and it will endeavour to provide a reply within 21 days.

If you are not satisfied with the Company’s response to your privacy concern or complaint, you have the right to lodge a complaint with the Office of the Australian Information Commissioner (OAIC).
